This website, thebarkingbrains.com, is run by Daniel Generous, an individual based in Boston, Massachusetts, USA, trading as "Tipsy Otis and the Barking Brains". When you use this site or buy music from it, you are contracting with Daniel Generous.

Accepting these terms

By using this site you agree to these terms. If you don't agree, please don't use it.

What we sell

We sell digital MP3 downloads of original recordings, as single songs or as a full EP. After payment you get a download link for the songs you bought. If you are buying as an individual, you must be of legal age to make purchases where you live, or have a parent's permission.

Payments and our reseller

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax and refund mechanics are covered by Paddle's Buyer Terms. See also our Refund Policy.

Your licence to the music

All songs, recordings, artwork, text and branding on this site belong to Daniel Generous and the credited musicians. Buying a song gives you a personal, non-exclusive, non-transferable licence to download it and listen to it for your own private, non-commercial use. You may not resell, redistribute, publicly broadcast, upload to file-sharing services, or use the music commercially without written permission.

Acceptable use

You must not misuse this site, including by:

• using it for anything unlawful, fraudulent, or to send spam;
• infringing our or anyone else's intellectual property;
• interfering with its security, such as uploading malware, probing for weaknesses, or scraping content in bulk.

Suspension

We may suspend or end your access to the site or to downloads if you seriously or repeatedly break these terms, don't pay, or create a security or fraud risk.

No guarantees

We do our best to keep the site and downloads working, but we can't promise they will always be available or free of errors. To the fullest extent the law allows, the site and music are provided "as is" without implied warranties, and our total liability to you is limited to the amount you paid us in the previous 12 months. Nothing here limits liability that can't be limited by law.

These terms are governed by the laws of the Commonwealth of Massachusetts, USA.
